Terms of Service

01Who these terms are with

PomoFit is operated by NEXO IV GRUPO, S.L. (ESB22740989), registered at Urb. Monja 22 – PBJ Fontaneres, 30811 Murcia, Spain. In these terms we are “we” and “PomoFit”, and you are “you”.

These terms cover the PomoFit mobile app and this website. By creating an account or using either, you agree to them. If you do not agree, do not create an account — and if you already have one, section 10 tells you how to close it.

Our Privacy Policy explains what we do with your data. It forms part of these terms.

02Your account

You need an account, because the app records what you finish and syncs it between your phone and the website. One account works on both.

• You must give an accurate email address and keep it current. It is the only way we can reach you and the only way you can reset a password.
• You are responsible for keeping your password to yourself, and for anything done through your account. Tell us promptly if you think someone else has access.
• You must be at least 16 to hold an account.
• One person, one account.

The name you give is shown to you in the app, and — only if you switch on the leaderboard — your first name is shown to other PomoFit users. Choose a name you are comfortable with on that basis.

03What PomoFit gives you, free

The following are free and we intend to keep them that way. If that ever changes we will tell you before it does, and anything you already have will not be taken away retroactively.

• The pomodoro timer, with focus, short break and long break phases.
• Exercises queued into your breaks, from the built-in library or ones you create yourself.
• Notifications at the end of a phase.
• Your own exercise library.
• Sync of what you finished, between your devices and the website.

The timer runs on your device and does not need us to be reachable. If our servers are down the clock keeps working, and what you finish is stored locally and sent when the connection returns.

04PomoFit Pro

Pro is a paid subscription that unlocks three things:

• Planning — laying out focus lengths and exercises for each day of the week in advance.
• Statistics — your totals and trends by week, month and year.
• Ranks — the community leaderboard, which is opt-in and off until you turn it on.

Prices and periods

Both figures include VAT. The price you see at the moment you subscribe is the price you pay — there is nothing added at the last step. Prices may change for future periods, but never for a period you have already paid for, and we will tell you before a change takes effect.

How renewal works

Pro renews automatically. Unless you cancel at least 24 hours before the current period ends, it renews for another period and your payment method is charged at the then-current price. This is how it works whether you subscribed through Apple or through this website.

Cancelling

You can cancel at any time, yourself, without contacting us or explaining why. Cancelling stops the next charge. It does not end the period you have already paid for — Pro stays on until that period expires, and then the account reverts to free. Your data is not deleted when Pro ends. Your plans and history stay exactly where they are, and become visible again the moment you resubscribe.

Refunds

For subscriptions bought through the App Store, refunds are handled entirely by Apple under their policy, and we cannot issue them. Ask Apple at reportaproblem.apple.com.

For subscriptions bought on this website: ask within 14 days of a charge and you get all of it back. No reason needed, nothing to justify. Email info@yotech.ai and it goes back to the card that paid it.

EU and UK consumers already have a statutory 14-day right to withdraw from a distance contract. We do not ask you to waive it in exchange for immediate access, which is the usual way that right gets taken away from you — the 14 days above are simply that right, honoured without argument. After 14 days, cancelling stops the next charge rather than refunding the current period, as described under “Cancelling”.

05This is not health advice

PomoFit suggests physical exercises and counts what you say you completed. It is a productivity timer with exercises attached — it is not a medical device, not a fitness professional, and not qualified to know anything about your body.

• It does not know your age, weight, injuries, medical conditions, pregnancy, medication or fitness level, and does not adjust for any of them.
• Nothing in the app is medical advice, physiotherapy, or a training programme designed for you.
• You decide whether an exercise is appropriate for you. If you are unsure, ask a doctor or a qualified trainer before starting — particularly if you have an existing condition or have been inactive for a while.
• Stop if it hurts. The app will happily suggest another twenty push-ups; it has no idea whether you should do them.

To the extent the law allows, we are not liable for injury arising from exercises you choose to perform. Nothing in this section limits liability for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded.

06Using PomoFit properly

Do not:

• Break the law with it, or use it to harm anyone.
• Try to access another person's account or data.
• Attack, overload, probe or disrupt the service, or attempt to get around rate limits, authentication or the Pro gate.
• Scrape, resell, or build a competing service out of our content or data.
• Falsify sessions to climb the leaderboard. It is meant to be a fair comparison, and it costs nothing to be honest.
• Use a name on the leaderboard that impersonates someone, or that is offensive.
• Reverse engineer or decompile the app, except to the extent the law expressly permits it.

If you break these rules we may suspend or close your account. Where it is reasonable to do so we will warn you first and give you a chance to put it right.

07The leaderboard

Ranks is off by default. Nothing about you appears until you switch it on, and switching it off removes you immediately. When you are on it, other signed-in PomoFit users see your first name and a total. Never your surname, never your email, never a specific session or day.

We may remove an entry, or a person, where we have reasonable grounds to believe the figures are fabricated or the display name breaches section 06.

08Who owns what

Your data is yours. Your sessions, plans, custom exercises and history belong to you. We claim no ownership over them and use them only to run the service for you, as set out in the Privacy Policy. That permission ends when you delete your account.

PomoFit itself is ours. The app, the website, the design, the name and the logo remain our property or that of our licensors. These terms give you a personal, non-exclusive, non-transferable licence to use the app for your own purposes — nothing more.

09Availability, and liability

We aim to keep PomoFit running and will not be careless about it, but we do not promise uninterrupted availability. The timer is deliberately built to survive an outage: it runs on your device and queues what you finish locally. Planning, statistics and the leaderboard do need the network.

We may change, add or remove features. If we remove something significant that Pro subscribers pay for, we will give reasonable notice and — where the change substantially reduces what you paid for — a pro-rata refund for the unused part of your period.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected. Subject to that, and to the extent the law permits, our total liability to you in any twelve-month period is limited to the greater of €100 and what you paid us in that period.

10Ending the agreement

By you

Delete your account whenever you like, from More → Delete account in the app. Deletion is immediate and permanent. Remember that it does not cancel an Apple subscription — see section 04.

By us

We may suspend or close your account for a breach of section 06, or if we are legally required to. Except where the law or the seriousness of the breach prevents it, we will tell you why and give you a chance to respond. If we close your account other than for a breach by you, we will refund the unused part of any period you have paid for.

Sections 08, 09 and 11 continue to apply after the agreement ends.

11Governing law and disputes

These terms are governed by Spanish law, and disputes will be dealt with by the courts of Spain. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, or of your right to bring a claim in your local courts.

Talk to us first. Most things that look like disputes are misunderstandings that a single email resolves: info@yotech.ai.

12Changes, and the rest

We may update these terms. When we do we will change the “last updated” date above, and for any change that materially affects your rights or what you pay we will tell you before it takes effect. Continuing to use PomoFit after that means you accept the new terms.

• Whole agreement. These terms and the Privacy Policy are the entire agreement between us about PomoFit.
• Severability. If a court finds part of these terms unenforceable, the rest continues to apply.
• No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.
• Transfer. You may not transfer your rights under these terms. We may transfer ours if the business is sold, provided your rights are not reduced.
• Apple. Apple is not a party to these terms and has no responsibility for PomoFit. Apple is, however, entitled to enforce them against you as a third-party beneficiary — a condition of distributing through the App Store.
